Terms of Service

Goods that are in stock (we are not liable for transport problems) are dispatched within 2 working days after receipt of payment. If the goods are not in stock when ordering, we will endeavor to deliver as quickly as possible. If the non-compliance with a delivery or service period is due to force majeure, industrial action, unforeseeable obstacles or other circumstances for which we are not responsible, the period will be extended accordingly. If the delivery deadline is not met for reasons other than those mentioned above, the buyer is entitled to set a reasonable grace period in writing with the threat of refusal and to withdraw from the contract after the unsuccessful expiry of the delivery or service in the contract. If the impossibility of delivery is due to the inability of the manufacturer or our supplier, both we and the buyer can withdraw from the contract if the agreed delivery date is exceeded by more than 2 months. Claims for damages due to delay or impossibility or non-fulfillment, including those that arose up to the withdrawal from the contract, are excluded. Unless a legal representative of BÜCHERL GALVANOSERVICE GMBH acted intentionally or through gross negligence.

If an order is canceled by the buyer before delivery of the goods, BÜCHERL GALVANOSERVICE GMBH is entitled to charge the buyer all costs incurred as a result of the cancellation. This applies in particular to the cancellation and cancellation costs charged to BÜCHERL GALVANOSERVICE GMBH by its suppliers. Goods that are free of defects may only be returned free of charge to BÜCHERL GALVANOSERVICE GMBH with your express consent. To compensate for the costs incurred, BÜCHERL GALVANOSERVICE GMBH is entitled to charge a processing fee of up to 10% of the value of the goods, but at least EUR 15 (plus VAT according to the statutory provisions) or to reduce the credit for returning the goods.

The risk is transferred to the buyer when the goods are sent by BÜCHERL GALVANOSERVICE GMBH.

BÜCHERL GALVANOSERVICE GMBH guarantees that the goods sold are free from defects in materials and workmanship at the time of transfer of risk and that they have the contractually guaranteed properties. Upon arrival, the customer must examine the goods immediately for defects and condition. Freight damage (packaging visibly damaged) must be noted on the shipping company's receipt papers and the company BÜCHERL GALVANOSERVICE GMBH must be notified in writing within 3 days. In the case of open defects, these must be reported to us in writing within 10 days of discovery, as well as hidden defects. In the event of complaints, the purchase date must be proven with the enclosed delivery note. The claimed item must be sent in with sufficient postage along with a copy of the delivery note. The guarantee does not extend to normal wear and tear. The guarantee expires if the customer changes the delivered goods. BÜCHERL GALVANOSERVICE GMBH has the right to free repair during the warranty period. A partial or complete exchange of the article is permissible. If defects are not remedied within a reasonable period, the buyer is entitled to change or a reduction.

All goods delivered by us remain our property until the buyer has paid all of his liabilities from the mutual business relationship. When the buyer processes the goods delivered by us, we are considered the manufacturer and acquire ownership of the newly created goods. All claims from the sale of goods in which we are entitled to property rights, the buyer assigns to us to the extent of our ownership share in the sold goods. The buyer must inform us immediately of any impairment of our rights to the goods in our ownership, in particular attachments and other confiscations. If the buyer does not fully meet his obligations towards us, he must return the goods to BÜCHERL GALVANOSERVICE GMBH on request without us withdrawing from the contract.

We advise our customers on application technology to the best of our knowledge within the scope of the given options, but without obligation. This applies in particular to the observance of any third party property rights. Our suggestions do not release our customers from the requirement to check our products and recommendations for their suitability for the intended purposes. Any setpoints mentioned in the analysis results come from the technical data sheets of the bathroom manufacturers or other sources. The achievement of a certain result with these values is not guaranteed. Addition, correction and supplementary recommendations are based on criteria that are recognizable on a laboratory scale based on the tests carried out and on the basis of the target values available to us. The applicability to the operating conditions of our customers is not guaranteed. No liability is accepted for any damage that may result.

Delivery always takes place including manufacturer packaging. We select other packaging according to the respective requirements. Additional costs that arise due to additional packaging will be invoiced separately. The customer's own packaging can only be used after prior agreement. The return of packaging in accordance with the statutory provisions is only possible after prior consultation with us.

In accordance with Section 28 of the Federal Data Protection Act (BDSG), we draw your attention to the fact that the data required in the course of business is processed and stored using an EDP system in accordance with Section 33 (BDSG). Personal data will be treated confidentially.

The place of performance and jurisdiction for both parts is the registered office of BÜCHERL GALVANOSERVICE GMBH. German law applies to the exclusion of the UN purchase law.

Should one of these regulations be ineffective, the effectiveness of the remaining regulations will not be affected. The ineffective regulation is replaced by the relevant legal regulation.
